1. About these terms
SWMSmate is made by Dropwire Digital, ABN 52 622 001 343 (“we”, “us”). These terms cover the swmsmate.com.au website and the SWMSmate skill, including its instructions, reference files and templates (together, “SWMSmate”).
By using the website or the skill, you agree to these terms. If you use SWMSmate for a business, you agree on behalf of that business. If you don't agree, please don't use SWMSmate.
2. What SWMSmate is
SWMSmate is a set of instructions and templates you add to your own AI assistant: Claude, ChatGPT or Gemini. When you ask for a SWMS, your AI assistant writes the draft using those instructions.
We don't run the AI, we don't see your chats, and we don't receive or store the SWMS you create. Each SWMS is drafted in your AI account and saved wherever you choose to keep it.
3. Safety and WHS disclaimer
Every SWMS that SWMSmate drafts is a draft. It is not approved, certified, checked by a WHS professional, or guaranteed to comply with any law, code of practice, or principal contractor's requirements.
SWMSmate provides general information only. It is not legal, WHS, engineering or other professional advice, and it doesn't replace a competent person who knows the site and the work.
You stay responsible. Under work health and safety laws, the business carrying out high risk construction work must prepare a SWMS, consult workers, make sure the work is done in line with it, and review it when things change. Using SWMSmate doesn't change who carries those duties.
Before anyone relies on a SWMS drafted with SWMSmate, you need to:
- check every job step, hazard, control and risk rating against the actual job and site
- resolve every item in the “Review before use” box and every highlighted CHECK
- confirm the licences, permits, notifications, legislation and codes of practice that apply in your state or territory
- consult the workers doing the job, and your principal contractor if there is one
- make sure workers have read and understood it before work starts
- review and update it when the work, the site or the conditions change
AI makes mistakes. A draft may miss hazards, suggest controls that aren't good enough for your situation, cite law that is wrong or out of date, or fill in details that aren't true. Results vary between AI models and between attempts, and may change when your AI provider updates its models. WHS and OHS laws differ between states and territories and change over time.
If you're unsure whether a control is adequate, stop and get advice from a competent person or your state or territory WHS regulator. Never rely on SWMSmate in an emergency. If someone is hurt or in danger, call 000.
4. Your AI provider and your data
You use SWMSmate inside your own account with Anthropic (Claude), OpenAI (ChatGPT) or Google (Gemini). Your use of those services is governed by their terms and privacy policies, not ours. Anything you type, including the names, phone numbers and addresses of workers, clients and sites, is sent to and processed by that provider.
Only enter information you're allowed to share, and think about your own privacy obligations to the people named in a SWMS. Check your provider's settings if you don't want your chats used to train their models. Our privacy policy explains what we collect on this website.
SWMSmate isn't affiliated with or endorsed by Anthropic, OpenAI or Google. Claude, ChatGPT and Gemini are trademarks of their owners. Those providers can change their plans, features and availability at any time, which may stop SWMSmate working on a platform. We can't control that.
5. The skill files and the MIT licence
The SWMSmate skill is free and open source. Its files are published on GitHub under the MIT licence, which sets out how you may use, copy, change and share them. If these terms and the MIT licence conflict about the skill files, the MIT licence applies.
Download buttons on this site fetch the files straight from that GitHub repository. If you change the skill, you're responsible for your version. The MIT licence doesn't let you use the SWMSmate name or logo in a way that suggests your version is ours or that we endorse it.
6. Using this website
The guides on this site are general instructions. AI apps change often, so menus and steps may not match exactly what you see.
The sample SWMS is for a fictional job and business. It's shortened and shown only to illustrate what SWMSmate produces. Don't use it as the SWMS for real work.
Apart from the skill files covered by the MIT licence, the content and design of this website, including the SWMSmate name and logo, belong to Dropwire Digital. Please don't use the site unlawfully or in a way that disrupts it for others.
We link to other websites, such as AI providers and government regulators. We don't control them and aren't responsible for their content.
7. No warranties
SWMSmate is free and provided “as is” and “as available”. Subject to section 8, we don't promise that the website, the skill, or anything drafted with it will be accurate, complete, current, suitable for your work, compliant with any law, or available without interruption or errors.
8. Australian Consumer Law
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or other law that can't lawfully be excluded.
Where we're allowed to limit our liability for breaching a guarantee that can't be excluded, our liability is limited, at our choice, to supplying the services again or paying the cost of having them supplied again.
9. Limitation of liability
To the maximum extent permitted by law, Dropwire Digital is not liable for any loss, damage, injury, penalty, fine, claim or cost, whether direct, indirect or consequential, arising from or connected with:
- your use of, or inability to use, the website or the skill
- any SWMS or other output drafted with SWMSmate, or any reliance on it
- errors, omissions or out-of-date information in the skill or its output
- the acts, omissions or availability of your AI provider or any other third party
This applies however the liability arises, including in negligence.
10. Changes
We may update the skill, the website and these terms at any time. Changes to these terms take effect when they're published here, and the date at the top shows when they last changed. If you keep using SWMSmate after a change, the updated terms apply.
11. Governing law
These terms are governed by the laws of South Australia, Australia. You and we submit to the non-exclusive jurisdiction of the courts of South Australia.
